As a member of the House Permanent Select Committee on Intelligence, I was able to review the "RESTORE Act of 2007" FISA legislation put forth by Democrats on Tuesday. This bill is full of flaws and does not give the intelligence community the tools needed to effectively conduct surveillance on terrorist, protect our national secrets, and prevent future attacks.
If enacted, the bill would implement policies such as: requiring the intelligence community to obtain a court order for foreign communications of persons believed to be outside the U.S., omits liability protection for telephone companies and other carriers that assisted the government after September 11, requires the FISA court to approve the intel community’s procedures for determining that there is a reasonable basis to believe that the telephone is located outside the U.S., creates an expiration date for the FISA laws and the list goes on. These provisions do nothing more than create more red tape that will impede intelligence gathering, slowing down and delaying action against terrorists, all to the detriment of our security.
