SEC. 503C. DIRECT-TO-CONSUMER DRUG OR DEVICE ADVERTISING.

`(a) Prohibitions-

`(1) FIRST THREE YEARS-

`(A) IN GENERAL- Subject to subparagraph (B), no person shall conduct direct-to-consumer advertising of--

`(i) a drug for which an application is submitted under section 505(b) before the end of the 3-year period beginning on the date of the approval of such application; or

`(ii) a class II or class III device for which a premarket notification is submitted under section 510(k) or a class III device for which a premarket approval is sought under section 515, before the end of the 3-year period beginning on the date of the notification or approval, respectively.
