We can both protect our civil liberties and give our government the necessary tools to fight terrorism. The FISA Amendments Act of 2008, a bipartisan measure, contains provisions that try to strike an appropriate balance, including prohibiting the targeting of a foreigner to eavesdrop on an American’s calls or e-mails without court approval and prohibiting the government from invoking war powers to supersede surveillance rules in the future while immunizing telecommunications companies that assist the intelligence community in thwarting terrorism. I believe deeply in the rule of law, which has been upheld in several Supreme Court rulings and by the FISA Court. I oppose torture, including waterboarding, which is ineffective, and would close Guantanamo.
